I'm not sure that matters if it occurred before or during his presidency. The Impeachment Clause does not reference any temporal component.

 

Ultimately, 'high crimes and misdemeanors' means whatever the House decides it means on any particular day.

There is rule that someone testifying can have their own counsel or agency counsel, not both. He volunteered to testify and have personal counsel. Someone from the DOJ showed up too, so he could not testify.

 

He will now be subpoenaed, and the DOJ and FBI cannot pull any maneuvers.
